New tenant fee schedule (all must be paid in full PRIOR to move-in)

*The first month's rent payment = $650-$1250 depending on size and finish level
*The Security Deposit + Move-in fee = equal to one month's rent
*Non-refundable credit supplement fee ($500) if applicable.
*Non-Refundable pet fee ($250-$500), if applicable.
* Non-refundable smoking fee, ($500), if applicable.
*Non-refundable prior felony conviction fee, ($500), if applicable.

Section 8, Cherokee Nation, etc assistance vouchers are accepted- but will NOT be considered without CONFIRMATION of benefits being submitted at time of application (upload letter stating your assistance benefits when you fill out the application).

Tenant requirements:

Tenants must meet the following minimum tenant requirements in order to be considered as a qualified rental candidate. Printed confirmation of meeting these requirements needs to be submitted at the time of application in order to be considered.

Complete tenant application/credit/background check through Avail.co (use the applicable link above to complete). A candidate will not be considered until a fully completed online application is received. No exceptions.

Ability to document 3x the monthly rent amount in gross (pre-tax) total household income (documentation: paystubs, copy benefit voucher/check/commitment letter). Please note, TEMPORARY assistance does not count towards income requirements.

Minimum of 550 credit score or payment of a one-time, non-refundable credit supplement fee at the time of application acceptance (application process through Avail.co includes a credit check).

Report any felony convictions within the last 3 years and provide Parole Officer’s name and contact information if applicable (application process through Avail.co includes a background check).

No history of evictions (application process through Avail.co includes eviction history)

Animals are allowed, but require pre-approval by management and a non- refundable fee, payable in advance. Maximum of 3 total animals allowed.

After approval by management, new tenants must immediately pay a non-refundable deposit-to-hold of $250 (which will be credited toward move-in costs following lease being signed) and sign a written lease within 24 hrs. Failure to submit the deposit and sign the lease within timeframes specified will result in cancellation of tenant’s approval and the unit will be offered to another potential tenant. Deposit-to-hold will not be returned.

Agree to and sign Community Rules and Standards as part of the application process, applications will not be considered complete without return of “Community Rules and Standards” (attached) signed by all adult applicants.

Tenant approval is ultimately at the sole discretion of park management.

Community Rules and Standards

A fully completed online application is required for all adults who will be living on the premises. Applications must be fully completed and submitted before tenants will be considered.

Signed leases are required for all mobile home lots and park-owned mobile homes.

All tenants must provide a valid phone number, email address, and forwarding address to management.

Rent will be paid in one of two ways, please let us know which method you prefer.
Avail.co online tenant portal (preferred- on time payments count towards building credit)- we will send you an email invite to register. Please include your email address below.
Cash deposit to FTE Real Estate, LLC (Account ######6768) at any BancFirst branch in Tahlequah (Please note that you must write your name, lot # and the date on the deposit ticket in order to receive credit for payment). Tenants must also retain receipts given by the bank for their records.

Rent is due the 1st of every month, a late fee of $100 will be charged to the Tenant on the 5th if the FULL rent amount is not received on or before the 5th of the month. An additional daily late fee of $20 will be charged for each additional day after the 5th that the FULL rent amount, plus any late fees is not paid in full. Eviction proceedings will be filed with the court on the 10th day that rent and fees remain unpaid.

All maintenance requests should be submitted online through the Avail.co portal under the “Maintenance” tab. On site maintenance will contact the tenant to schedule a maintenance appointment. Failure of tenants to meet set appointment times will result in a $25 missed appointment fee, payable before any repairs will be made. Discovery of unsanitary living conditions by maintenance will also result in cancellation of the maintenance appointment and the $25 missed appointment fee. Maintenance will not return to complete any repairs until photo-proof of improved sanitary conditions is received by management.

Repairs deemed to be the direct result of tenant damage or negligence will be billed back to the tenant and payable immediately. Failure to pay these charges within 5 days will result in a written notice, with eviction proceedings being filed 10 days following the date of the unpaid charge.

Upon move-in, tenants will be given a key to their home, and a key for their mailbox. Lost keys will result in a $50 key replacement charge. If a tenant gets locked out and requires maintenance to unlock their door, there will be a $25 charge.

All adults residing in the community must be included in the written lease agreement and approved by park management PRIOR to moving in. Any changes in occupancy must be reported to the manager so that the lease can be updated- all adults must be registered on the lease and will be liable for any and all rent. Failure to abide by this standard will result in lease termination for the entire household and a written 5 day notice to vacate.

Tenants renting only a lot and residing in a privately owned home are responsible for proper connection of all utilities. FTE Real Estate reserves the right to inspect any and all utility connections for safety compliance at any time.

Water and trash service are provided by park management. Tenants are responsible for electric and natural gas utilities. Utilities must be maintained and with connected service at all times.

Maintenance of a safe, sanitary, functional, habitable place of residence is required. Failure to maintain such is grounds for immediate lease termination and removal from the property at the Landlord’s discretion. Interior condition inspections for overall cleanliness and state of repair will be performed by management quarterly.

Each tenant is required, at minimum, to hold liability insurance covering their lot and contents. Proof of insurance is required to be submitted to the Landlord either online or by mail prior to move-in.

Quiet hours are observed from 10pm to 6am every day in polite consideration of surrounding neighbors.

All tenants are to conduct themselves in a reasonable and respectful manner at all times. Domestic disturbances, law enforcement dispatch, violence, verbal or physical threats against management, the landlord, other tenants, or guests is strictly prohibited, and is grounds for immediate lease termination and removal from the property. Landlord is notified automatically of any and all law enforcement dispatches to the property.

The tenant will be responsible for keeping their entire lot and designated parking area in good, uncluttered condition. Accumulation of trash, debris, furniture, or junk on the lot is not permitted. Unacceptable lot appearance issues will result in a written notice, and must be remedied to landlord’s satisfaction immediately or within the timeframe noted on the notice. If a second notice is received for the same issue, tenant will be subject to a $100 fine. If the issue remains incomplete by the date specified on the 2nd notice, and/or tenant has not paid the fines due, tenant will be given a 10 day notice to vacate the premises and/or move their mobile home (if owned) from the property. If the tenant has not vacated the property and/or the mobile home is not removed within the 10 day notice, court action will be taken and all reasonable cost of attorney fees will be paid by the tenant.

It is the responsibility of each tenant to mow their lot and to ensure no tall weed growth around their home. If the tenant’s lawn reaches an unacceptable height, the lawn will be mowed at the tenant’s expense of $35 per occurrence. Each tenant is also responsible for any snow removal on their lot, sidewalk and/or designated parking area.

Designated parking for each lot is the two car widths immediately in front of the lot. A maximum of two vehicles are allowed per lot.

No storage on inoperable/ non-running vehicles is permitted. Landlord reserves the right to have any inoperable vehicle towed from the property at the tenant’s expense.

A maximum of three (3) total animals are allowed per lot. All dogs must be kept on a leash or in a secure pen at all times when outdoors per City of Tahlequah ordinance. All animals must be up to date on all vaccinations and spayed/neutered (Tahlequah Animal Control provides these services FREE OF CHARGE). No aggressive animals are permitted on the premises. Non payment of rent and/or assessed fees will result in legal collection and/or eviction. Written notice of non-payment will be given 5 days after the payment was due, with lease termination and removal from property 5 days following written notice, with legal proceedings initiated 10 days after the payment was due. All reasonable legal costs and attorney fees will be the responsibility of the tenant. An eviction filing fee of $250 will be charged if eviction proceedings are filed.

Following an eviction, locks will immediately be changed. The tenant will have 15 days, per Oklahoma law, to retrieve any personal property left on the premises, Landlord reserves the right to move any personal property to a different, secure location for retrieval. Tenants must contact management in order to set up a time in advance to retrieve their property. No access to the unit will be permitted without management approval.

If the tenant moves, abandons the residence, is evicted or otherwise ceases to reside at the leased space or residence, the Landlord shall give the tenant reasonable notice, by certified mail or personal service to forwarding address provided (if any if provided), of the Landlord's intent to dispose of the property. If the tenant does not claim the property within fifteen days after the notice is given, the property shall be considered abandoned and may be disposed of without liability to the tenant.

Absolutely no illegal drug use, possession, distribution, etc is allowed on the property- any illegal drug activity suspected, or confirmed, is grounds for immediate lease termination and eviction of the household from the property.

**Cherokee County Sheriff’s department and City of Tahlequah police are aware of this lease provision and will report any drug related calls to management and assist in evictions**

Public intoxication is not permitted. Repeated reports will result in lease termination.

Subletting your lot to another person not on your lease is NOT permitted without the written consent of the Landlord.

The tenant will be responsible for completing and returning a move-in inspection checklist upon lease initiation, and will also be responsible for completing the move-out portion of this checklist upon lease termination. Failure to complete and return this checklist upon lease termination will result in forfeit of the entire deposit.

Early termination of their lease, or failure to give adequate notice per their lease agreement by the tenant, will result in forfeit of any deposit held, and the tenant will be liable for payment in full of the current month’s rent, regardless of the date of move-out.
